The Process

What your solicitor will do for you:

Purchase

  • Obtain all the details about the Seller and their Solicitor from the estate agents.
  • Confirm instructions to the sellers solicitor and request the contract and supporting documents.
  • Obtain relevant searches, including Local Authority search, provide a full report to you on any matters contained in the results.
  • Provide a report on the terms and any conditions of your mortgage offer .
  • Provide a full detailed report on the title to the property, i.e. details of the boundaries, any restrictions affecting the property and any requirements of the owner to perform / undertake certain duties responsibilities.
  • Arrange for you to sign the Contract
  • Exchange contracts – NB. when contracts are officially exchanged the buyer and the seller are legally bound to the transaction
  • Prepare the Transfer deed
  • Arrange for you to sign Transfer deed and Mortgage deed
  • Request final pre-completion searches
  • Prepare final Completion Statement (showing all financial transactions)
  • Ensure all funds in place in time for completion
  • Deal with completion - transfer of funds, ensuring hand over of keys.
  • Deal with Stamp duty formalities.
  • Deal with registration of new owner at HM Land Registry.
  • Forward deeds to lender / and or client


 

What your solicitor will do for you:

Sale

  • Obtain title deeds from existing lender or Land registry.
  • Draft Contract and forward to purchaser's solicitors.
  • Arrange for signature to contract.
  • Reply to any queries raised by purchasers solicitors.
  • Exchange contracts – NB. when contracts are officially exchanged the buyer and the seller are legally bound to the transaction.
  • Request redemption figures for existing mortgages.
  • Approve Transfer deed supplied by purchasers solicitor and arrange for signature.
  • Prepare final Completion Statement (showing all financial transactions).
  • Deal with completion - receipt of completion monies, ensuring handover of keys.
  • Discharge any outstanding mortgages
  • Discharge Estate Agents account.
  • Forward all Title deeds and relevant documents to purchaser’s solicitors.
  • Transfer any balance of sale proceeds to seller.
