However, the definition of a package is complex and must at the very least:

• Be sold or offered for sale
• Be sold at an inclusive price
• Be pre-arranged
• Include a minimum of two of the following three elements:
  
  1. transport
  2. accommodation
  3. other tourist services accounting for a significant proportion of the package such as a tour guide.

The package holiday regulations do not apply and the accident took place in a country that is within the European Union a defendant such as a hotel situated in Spain would probably have to be sued there.
