The Package Travel, Package Holidays and Package Tours regulations 1992 set out in detail the travel organisers' responsibilities to their customers and remedies available to them should they occur a breach of the regulations. They provide the purchasers of package holidays with statutory legal rights against tour operators, thus meaning that if you have purchased such a package and are injured abroad; we will be able to sue on your behalf the travel organiser in this country rather than having to pursue the claim in a foreign country. However, the definition of a package is complex and must at the very least:
- Be sold or offered for sale
- Be sold at an inclusive price
- Be pre-arranged
- Include a minimum of two of the following three elements:
1. transport
2. accommodation
3. other tourist services accounting for a significant proportion of the package such as a tour guide.
The package holiday regulations do not apply and the accident took place in a country that is within the European Union a defendant such as a hotel situated in Spain would probably have to be sued there.
